No Diversion

No DiversionPeople defending domestic violence charges are not eligible for the county diversion program. San Francisco has a pretrial diversion program that many people are eligible for if they do not have a criminal history. Diversion enables people to keep their records clean for job application purposes. Diversion still counts as a conviction for immigration purposes. (Cases such as first-time nonviolent cases are often sent to pretrial diversion. If a judge makes a finding of good cause cases involving battery that do not involve domestic violence, a case can be sent to diversion.)

You also can’t civilly compromise a domestic violence case, that is make an agreed upon financial settlement with the victim in exchange for the charges being dismissed. It is against the law for a victim or their representative to demand money in exchange for “dropping the charges.” A victim has very limited control over whether a case proceeds or not.
